Commentary by Attorney Michael Grossman
When a pedestrian on a mobility scooter is struck by an 18-wheeler, the first question that comes to mind is: How did this collision happen? The reports don’t tell us whether the truck was turning, backing up, or simply traveling down the street when the impact occurred. Without that information, it’s impossible to know whether the driver saw the pedestrian, whether visibility was limited, or if other factors were involved.
A proper investigation should focus on several key areas:
- Driver’s actions and visibility: Was the driver distracted, fatigued, or otherwise inattentive? Were there blind spots that made it difficult to see the pedestrian, and should mirrors or cameras have helped avoid the collision?
- Event data and cameras: Many 18-wheelers have dash cams or black box data that can show the truck’s speed, braking, and steering leading up to the crash.
- Roadway and environment: Were there obstructions, poor lighting, or unclear crosswalk markings that contributed to the incident?
- Witness statements: People nearby may have critical information about how the pedestrian and truck entered the same space.
Even though only one truck and one pedestrian were involved, that doesn’t mean this was a simple matter of being in the wrong place at the wrong time. Evidence can often reveal whether this was avoidable and if driver actions, vehicle equipment, or roadway conditions played a role.
Key Takeaways:
- The reports do not explain how or why the pedestrian and truck ended up in conflict, leaving key questions unanswered.
- Investigators should review black box data, dash cams, and witness statements to clarify events.
- Visibility, distraction, or inadequate safety checks may have contributed and need to be examined.
- Determining accountability requires analyzing more than just the final moments of impact.
