Commentary by Attorney Michael Grossman
When an 18-wheeler overturns with a child riding as a passenger, two questions immediately come to mind: Why did the truck lose control, and why was a child in the cab in the first place? The reports don’t provide answers to either, which makes it impossible to understand whether this crash was the result of driver actions, mechanical problems, or unsafe conditions inside the truck.
A thorough investigation should focus on several areas:
- Cause of loss of control: Mechanical inspections, black box data, and dash camera footage could help determine whether speed, braking, steering issues, or shifting cargo played a role.
- Company policies on passengers: Many trucking companies restrict or prohibit children from riding in commercial vehicles because of the risks involved. Investigators will need to determine if the driver had authorization to bring a passenger, and whether any safety protocols were followed.
- Roadway factors: Conditions such as wet pavement, debris, or poor road design could also have contributed and shouldn’t be overlooked.
- Driver training and oversight: A review of the driver’s history and the company’s supervision may show whether the truck was operated in a safe manner leading up to the rollover.
This crash raises more questions than it answers. Until investigators release additional information, it’s unclear whether this was a case of equipment failure, a preventable driving error, or a lapse in safety policies that put both the driver and child in harm’s way.
Key Takeaways:
- The reason for the loss of control remains unknown and needs further investigation.
- Company rules and safety policies regarding passengers in commercial trucks are a key issue.
- Black box data, mechanical inspections, and roadway analysis can provide critical evidence.
- Accountability may extend beyond the driver to the trucking company or others responsible for safety oversight.
