I’ve been doing this job for over 30 years now, and still the most common misconception I deal with is that someone hitting the back of another vehicle is automatically responsible for the crash. The law is more nuanced than that.
What if the front vehicle cut off the rear driver? What if they had brake lights that didn’t work? What if they were disabled in the roadway and didn’t have any cones or flares marking the obstruction? I’m not saying that the rear driver is never responsible. In fact, it’s common for things like speed and distraction to lead to wrecks like this. But until there is clear evidence one way or another, speculating isn’t going to do any good.
In fact, it can be harmful if authorities are too quick to judgment and allow crucial evidence to slip through the cracks. That’s why a rear-end collision like this is as worth a thorough and open-minded investigation as any serious commercial vehicle wreck. At the end of the day, the facts need to speak for themselves.
