Commentary by Attorney Michael Grossman
When a motorcycle goes down with no other vehicles involved, it’s easy for the explanation to stop at “loss of control.” But that phrase doesn’t tell us why it happened, and the real cause can only be uncovered if the investigation looks deeper than the surface.
1. Did the authorities thoroughly investigate the crash?
Motorcycle wrecks often get less detailed attention than multi-vehicle collisions. Yet even here, there are important questions: Were there skid marks showing an attempt to brake or swerve? Did investigators reconstruct the rider’s path to understand what led to the crash? Without that kind of careful analysis, the event risks being written off without real answers.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Sport bikes are precision machines, but they’re not immune to failure. A brake malfunction, throttle issue, or suspension problem could instantly make the bike uncontrollable. Tires are another common point of failure. If the motorcycle was cleared from the scene before a full inspection, any evidence of a defect may already have been lost.
3. Has all the electronic data relating to the crash been collected?
Many modern motorcycles are equipped with electronic systems that track speed, throttle position, and braking. In addition, a phone, GPS, or helmet camera could hold valuable information about the moments leading up to the crash. If investigators haven’t collected that evidence, the picture of what really happened will remain incomplete.
Crashes like this don’t occur in a vacuum. Whether the cause lies with the rider, the bike, or something in between, the truth depends on asking the right questions and preserving the evidence before it’s gone.
Takeaways:
- It’s unclear whether investigators reconstructed the bike’s path or braking attempts.
- A possible defect with the tires, brakes, or throttle may not have been ruled out.
- Digital evidence from the motorcycle or devices could hold key insights if reviewed.
