Commentary by Attorney Michael Grossman
When a vehicle leaves the roadway on a major interstate, overturns, and results in a fatality, it is critical that the investigation focus on more than just surface-level assumptions. These types of single-vehicle incidents are often dismissed as simple loss-of-control events, but in my experience, a meaningful analysis must begin with three key questions that reveal whether the crash was truly unforeseeable—or if other factors played a role.
First, has a thorough investigation been conducted at the scene? On a roadway like Interstate 80, where speeds are high and traffic is heavy, investigators must examine every relevant detail—road surface conditions, tire marks, guardrail positioning, lighting, and possible obstructions or debris in the median. Understanding whether the vehicle’s departure from the road was abrupt or gradual helps reconstruct what took place and whether the driver had any opportunity to react. A complete review of environmental and roadway conditions is the first step in identifying whether this was a purely operator-driven incident or influenced by external factors.
Second, has anyone considered whether a mechanical or electronic failure contributed to the crash? A sudden loss of control could indicate issues with critical systems such as the steering, brakes, or suspension. Vehicles like the Ford Mustang, which are performance-oriented by design, require precise handling inputs and properly functioning stability controls to remain safe at highway speeds. If any component failed or failed to respond as expected, the result could be a rollover even without excessive speed or erratic maneuvering. These systems should be evaluated carefully to determine whether they played a role in the vehicle’s loss of control.
Third, has all available electronic data from the vehicle been retrieved and analyzed? Modern vehicles are equipped with electronic control modules (ECMs) that record detailed information in the seconds leading up to a crash—vehicle speed, brake application, throttle input, and steering data among them. This data can help clarify whether the vehicle responded to driver inputs or if something unusual occurred. Additional evidence such as surveillance footage, dash cam data, or phone records may also provide insight into the driver’s actions and situational awareness before the crash.
Rollover crashes at highway speed are rarely simple. To understand why this crash happened, and whether anything could have been done to prevent it, investigators must work through these three questions. Only then can those affected by the loss begin to get the answers they need—and only then can we say with confidence that the full story has been uncovered.
