Commentary by Attorney Michael Grossman

People tend to think that something like a driver allegedly running a red light would automatically result in serious charges. However, not all accidents are the same, and few are ever as straight-forward as they seem. In fact, this crash involving a motorcyclist raises concerns about just how thorough authorities have been in the investigations. I’ve seen far too many situations where a victim is unfairly blamed just because they’re a motorcyclist.

The unfortunate reality is a lot of people have a negative view of motorcyclists. They’re seen as inherently reckless despite the fact most of them are safe drivers. Even in situations where another driver makes a mistake—running a light, for example—there may still be those willing to put blame on the motorcycle rider just because they assume the rider must have also been doing something wrong.

One of the best tools against this unfair bias is evidence, plain and simple. The more evidence there is telling the victim’s side of the story, the less room there will be for speculation and jumping to conclusions. That’s why victims and families are generally better off when they’re proactive with getting answers rather than waiting around for authorities to get those answers for them. The same could very well prove true here if there haven’t already been steps taken to conduct careful, unbiased investigations.
