Commentary by Attorney Michael Grossman

When incidents like this occur, they often leave unanswered questions about what led to the crash. Authorities allege that the driver of the Polaris Ranger was under the influence of alcohol, which raises significant concerns about how and why they were in that condition behind the wheel.

In cases where intoxication is suspected, it’s essential to investigate not just the driver’s actions but also where they may have consumed alcohol before the crash. Texas law prohibits alcohol providers from serving individuals who are obviously intoxicated. If the driver was overserved at a bar, restaurant, or other establishment, that business could share responsibility for the injuries under Texas dram shop law.

Dram shop laws are designed to hold alcohol providers accountable for reckless service, helping to reduce the number of preventable crashes. By enforcing these laws, we ensure that businesses follow the rules and take their responsibility seriously, creating safer environments both inside and outside their doors.

For the injured passenger, understanding the full circumstances of this crash is vital—not only to seek justice but also to ensure that anyone who may have contributed to this incident is held accountable. A thorough investigation into where the driver obtained alcohol and whether the law was followed is a critical step toward preventing similar crashes in the future and keeping Texas roads safe for everyone.
