Commentary by Attorney Michael Grossman

When it comes to intoxicated drivers, people tend to give their attention only as far as that driver facing charges. Once someone has been charged, folks generally move on. Even authorities do this. A lot of the time, though, there’s more to the story. In fact, there could be an accomplice who needs to be held accountable: a negligent alcohol provider.

In Texas, alcohol providers can face consequences if they unlawfully over-serve someone who is obviously intoxicated. This can expose them to potential criminal investigations, fines, suspended licenses, or liability for the injuries caused by the intoxicated. Not only can this serve as punishment for those negligent alcohol providers, it can also be a vital tool for ensuring they clean up their act before more people get hurt.

Unfortunately, negligent alcohol providers often slip through the cracks. I’ve handled confronted hundreds of negligent alcohol providers for their role in victims suffering harm in a drunk driving accident. A lot of the time, we’re the only ones paying the alcohol providers any attention. I’ve even had cases where we handed over evidence to authorities on a silver platter, and they still dropped the ball. Maybe authorities here have already worked to find out if any alcohol providers contributed to this accident. However, it’s something I learned a long time ago not to take for granted.
