Commentary by Attorney Michael Grossman

When I read about a crash involving a passenger vehicle and a snowplow, like this one on Interstate 90, the immediate question is how the Kia Sorrento lost control in the first place. Snowplows are essential for keeping roads passable in winter conditions, but their size and slow speed can pose risks for other drivers, particularly when visibility or road conditions are poor. Understanding what led to this crash is critical to determining accountability and identifying preventive measures.

One key factor investigators should consider is the condition of the roadway at the time of the crash. Was the road icy, snow-covered or otherwise hazardous? If so, did those conditions contribute to the Kia losing control? While snowplows work to improve safety, they often operate in challenging conditions, and it’s essential to understand whether the driver of the Kia adjusted his speed and driving behavior appropriately for the weather.

The position and actions of the snowplow also warrant scrutiny. Snowplows often create unique traffic patterns, and their visibility can sometimes be compromised by the snow they kick up. Was the snowplow clearly marked and equipped with proper warning lights? Was it traveling in a way that allowed other drivers to anticipate its movements? These questions are vital for assessing whether the snowplow’s operation contributed to the collision.

Another consideration is the role of the Kia’s condition. Did the vehicle have properly maintained tires and brakes suited for winter driving? Investigators should also consider whether external factors, such as poor visibility or sudden obstacles, played a role in the loss of control.

Finally, the broader environment of snowplow operations on busy highways like Interstate 90 is worth examining. Do local authorities have policies in place to minimize the risk of collisions between snowplows and other vehicles? For instance, was the snowplow operating at a time or in a manner that unnecessarily increased the risk to other drivers? If systemic issues contributed, they should be addressed to improve safety during winter road maintenance.

This crash highlights the challenges of winter driving and the potential risks posed by snowplow operations on busy roads. My hope is that authorities will examine every angle, from road conditions to operational practices, to provide answers and promote safer highways for all drivers.
