Commentary by Attorney Michael Grossman
While alcohol has yet to be confirmed, it’s obviously a serious detail to bring up. What makes it particularly challenging, though, is that both drivers involved here lost their lives. While authorities are sometimes as thorough as possible following any serious crash, some departments are quick to move on if there’s no one to charge. But with alcohol-related accidents, drivers aren’t the only ones who may be responsible for the accident. There may have been a negligent alcohol provider involved here who still needs to face appropriate consequences.
In Texas, alcohol providers who over-serve obviously intoxicated persons can potentially face criminal investigations, fines, suspended licenses, or liability for the deaths or injuries caused by the intoxication. I’ve handled hundreds of cases against negligent alcohol providers, and frankly there far more who could be held accountable for their actions. Unfortunately, they tend to fly under the radar when authorities fail to extend their investigations beyond an accident scene. That allows those establishments to continue putting lives at risk, and more families are bound to lose a loved one.
Again, it’s possible alcohol wasn’t a factor here, and if it was, there may not be a negligent alcohol provider involved. But two people lost their lives, and a child was sent to the hospital. If details like that don’t warrant every possible step to get the facts about what all happened here, I don’t know what would.
