Commentary by Attorney Michael Grossman
When I see reports of a crash like this, my first thought is that the families of those involved deserve clear answers about what happened. A fatal head-on collision raises serious questions, and in my experience, these incidents are rarely as straightforward as they might seem. Before any conclusions can be reached, three critical areas need further investigation.
First, did authorities conduct a thorough investigation? Determining why a vehicle crossed the center line is essential. Did investigators examine the roadway for hazards such as debris, poor lighting or sharp curves that may have contributed? Were skid marks or steering inputs analyzed to determine whether the driver of the Nissan attempted to avoid the collision? Were weather or road conditions a factor? A complete accident reconstruction should explore all these elements rather than assume driver error was the only cause.
Second, has anyone looked into whether a vehicle defect contributed to the crash? The Nissan involved in this accident is over a decade old, meaning mechanical failures such as brake malfunctions, steering issues or tire blowouts could be possibilities. If the driver lost control because of a mechanical failure, that would change the way this crash is understood. Additionally, given the severity of the collision, it is important to determine whether the safety systems in both vehicles — such as airbags and seat belts — functioned as expected. A forensic inspection of both vehicles is critical to ruling out mechanical or safety failures.
Finally, has all available electronic data been collected? Both the Nissan and the Ford Fusion likely have engine control modules (ECMs) that store key information such as speed, braking and steering inputs leading up to the crash. Retrieving this data could help clarify whether the Nissan driver attempted to correct course or if the vehicle failed to respond. Additionally, any nearby traffic or surveillance cameras may have captured footage of the vehicles leading up to the collision. Phone records should also be reviewed to determine if distraction played a role.
At the end of the day, three people lost their lives in this crash, and their families deserve to know exactly what happened. A full and thorough investigation is the only way to ensure that no key details are overlooked. If any of these three questions remain unanswered, these families simply don’t have the full story.
