Amarillo, TX — December 23, 2024, Anthony Soto was injured as the result of an alleged drunk driver accident at around F.M. 1541.

According to initial details about the accident, it happened in the area of S.W. 43rd Avenue.

Investigators said that 27-year-old Anthony Soto was on a Harley-Davidson traveling southbound along the roadway. While doing so, an eastbound Toyota reportedly failed to yield the right-of-way, resulting in a collision with Anthony Soto.

Due to the accident, Soto sustained serious injuries. The other driver allegedly tested nearly twice the legal limit for drunk driving. Charges aren’t clear right now.

If it’s true the allegedly at-fault driver here was nearly two times the legal limit, that raises a serious question that authorities may have overlooked: Did a local alcohol provider unlawfully over-serve that driver? Here’s why that matters.

Under Texas dram shop laws, bars, restaurants, and other establishments can be held accountable if they over-serve alcohol to someone who is obviously intoxicated. When a driver is nearly twice the legal limit, it’s worth investigating whether they were drinking at a business that ignored clear signs of impairment. If that happened, the establishment may share responsibility for this crash.

Far too often, people focus only on the driver’s actions, but drunk driving crashes don’t happen in a vacuum. If a bar or restaurant played a role by over-serving this driver, then addressing that issue is critical to preventing similar crashes in the future. So while there should obviously be appropriate consequences for a drunk driver’s actions, steps should also be taken to find out if there are any accomplices.
