Commentary by Attorney Michael Grossman

When it comes to single-vehicle accidents, people are sometimes too quick to move on without considering all possibilities. Even authorities can be guilty of this. I get calls all the time from folks whose crashes were more or less brushed aside once authorities had other jobs to move on to. This can lead to serious oversights, since even seemingly basic crashes can involve very complex issues.

For example, I rarely see authorities take proper steps to have a vehicle analyzed for potential defects. Modern vehicles have a lot that can go wrong. Crash avoid systems, automatic braking, power steering, airbag sensors, and even seatbelts can fail or under-perform when they’re most needed. As a result, drivers sometimes end up more seriously injured than they should be.

Common or not, these possible defects require state-of-the-art tools and a lot of experience and training to rule out. If authorities are solely focused on more common factors, they could easily miss something more intricate that a proper accident reconstruction could suss out. This isn’t just vital for victims and families who may be affected by these issues, but also overlooking potential defects could allow dozens or hundreds of vehicles with the same issue to continue operating on the roads until someone else gets hurt.

That’s why, regardless of what causes a crash, experience taught me an important question to ask: Were steps ever taken to preserve the victim’s vehicle and have it properly inspected?
