Commentary by Attorney Michael Grossman
When a truck accident like this occurs, it naturally brings on calls for accountability—rightfully so. But that accountability is rarely as straight forward as folks may realize. Barring some unusual, unavoidable crash, accidents like the one described here are usually the result of reckless driving. The question is whether that recklessness was a single individual or a series of avoidable choices that could still be putting lives at risk.
For example, I've had cases where rigorous delivery schedules compromised driver safety, so they made reckless decisions they likely wouldn't have otherwise. I've also seen plenty of examples where overlooked vehicle maintenance led to completely avoidable accidents. Worn tires, for instance, can play a huge role in crashes during rainy weather. If authorities just assume an individual driver's actions are the only reason a deadly wreck might happen, they're likely to overlook serious issues that require more thorough investigations.
That's why it's critical to shed light on these possible contributing factors. The victim's loved ones deserve to know the whole story, and they also deserve to know any and all parties who wronged them are being held accountable. That's especially true if doing that also helps prevent future accidents.
