While things may seem open-and-shut here, experience tells me there could be more to this story. When it comes to wrong-way drivers, investigations often show that the driver was significantly intoxicated. Drivers who are that drunk usually had help getting that way. That’s why investigations should include any potential negligent alcohol providers.

Simply put, if a bar or other establishment serves someone to the point they can’t tell what side of the road they’re on, it’s very likely they unlawfully over-served that person. Texas law says alcohol providers who do so can be responsible for resulting accidents that leave people seriously hurt or killed. Not only can this help ensure there’s accountability for the harm done to the victims, but it can also put negligent alcohol providers on the straight-and-narrow before their actions lead to more people getting hurt.

Too often, though, authorities overlook this area of the law. Their efforts typically focus on the alleged drunk driver behind the wheel. Even when that person deserves to face charges, though, failing to root out accomplices in the form of negligent alcohol providers only allows them to continue recklessly putting the community at risk. So if alcohol did indeed lead to this crash, it’s important to know where that alcohol came from before considering the matter closed.
