Commentary by Attorney Michael Grossman

The OSHA summary doesn’t give a lot of information on this, and it leaves a lot of questions. What caused this machinery to slip? Were there other workers moving the machinery at the time? Did they work for the same company as the victim? Was the equipment used to secure or move the object in poor condition? Did investigators inspect it for defects?

People might think authorities surely looked at all of this behind the scenes. However, I speak to families all the time who wait for months on end still asking the same questions they were on day one. The fact of the matter is authorities don’t always go out of their way to help families, and that can include simply giving them clear answers. That sometimes takes thorough independent investigators stepping in to fill in the blanks and ensure the worker’s family finally gets some answers. It wouldn’t be unusual if those steps proved necessary here, as well.
