Commentary by Attorney Michael Grossman
With OSHA recommending penalties here, people might think this matter is all resolved, and they likely just gave answers to the victim’s loved ones behind the scenes. Well, it might surprise folks how little information OSHA actually provides to a lot of families.
Simply put, OSHA has their own priorities. Rarely do their efforts put the needs of a family first. That’s why many families only get clear answers once they bring in independent investigators who can gather evidence on their own. OSHA’s efforts might overlap with the needs of a family, but those efforts alone rarely do enough.
This is particularly important to keep in mind given that Texas work fatality law is more complex than in any other state in the country. There is not always a guaranteed path for getting people a resolution. As such, it’s often up to the families to seek that path themselves. That means gathering clear evidence and having the legal tools to navigate the legal maze that is Texas work fatality law. Have those steps been taken here?
