Commentary by Attorney Michael Grossman

Frankly, it’s not unusual for OSHA to release so few details about a deadly work accident to the public. The question, though, is if they’ve given more information to the worker’s family behind the scenes. It would surprise people how often families found themselves months after an accident still asking the same old questions they had on day one. Why does that happen?

Put simply, OSHA isn’t here to look out for workers’ families. Their job is to find violations and recommend penalties. Families, meanwhile, have to navigate Texas work fatality law, which is more complex than in any other state in the country. That legal maze takes a lot more than just pointing out violations or fines, and the type of evidence and legal strategy needed rarely overlaps one-to-one with an OSHA investigation.

So, regardless of what led to this accident, it’s important to know that there are professionals looking out for the needs of the victim’s loved ones. Whatever path lies ahead for them, having the right evidence and strategy early on can make the difference between a family being left in the dark and a family getting the resolution they deserve.
