Commentary by Attorney Michael Grossman
The allegations OSHA included in their investigation summary are more than a little concerning. However, they may also just be the tip of the iceberg. After any fatal work accident, OSHA might find various violations, but there could be other questions the worker’s loved ones have which may still be unanswered.
Did the worker’s employers not provide the safety equipment? Was the equipment not in working condition? Were workers being forced to work in unsafe conditions under threat of losing their jobs? Had the victim or other workers made complaints about the employer in the past?
OSHA’s efforts are always important to take into account after a worker losing their life. However, it’s also important as many steps as possible are taken to consider all the facts. Not only do families deserve the full story, but they generally need as much information as possible to get a just resolution.
