Commentary by Attorney Michael Grossman
I get questions a lot about dog bite incidents, as the laws surrounding them aren’t exactly common knowledge. It’s not strictly as simple as finding the owner and putting all the blame on them. Essentially, Texas has a One Bite Rule. Animals can be unpredictable, and they can go their whole lives without incident only to one day attack someone. If that happens, owners aren’t generally responsible for that. After that, however, the risk is known. Therefore, future incidents of a dog attacking someone become foreseeable and preventable. Owners can then be held accountable if a dog with a known risk of harming others goes on to do so again. Did that happen here?
