Commentary by Attorney Michael Grossman
Explosions are challenging enough to investigate, but the fact this happened at a business is only going to present additional hurdles for those affected. For one, there’s already the challenge of finding the cause of the explosion. Was it related to work responsibilities? Was it a maintenance accident? Were there faulty gas lines or appliances or machines that were installed poorly?
On top of all that, there’s the inherent challenge of Texas having the most complex work accident laws in the whole country. Simply put, not every employer offers a guaranteed path for workers to get benefits after an accident. As a result, workers may have the burden of dealing with their recovery as well as putting their story together to make sure they get a resolution that’s as fair to them as possible.
These challenges combined can certainly seem daunting, but Texas offers plenty of avenues for folks to prepare for these hurdles and confront them appropriately. It’s just a matter of taking steps early to learn about what options are available and what evidence will be needed to explore those options.
