Commentary by Attorney Michael Grossman

Any time a crash happens in the early morning hours involving a commercial truck and a smaller vehicle in the middle of a turn, it’s important to consider whether visibility, speed or right of way played a role, and to confirm who actually had the legal obligation to yield.

In this situation, the smaller vehicle was reportedly making a left turn when the crash occurred. That may lead some people to assume the turning vehicle is always at fault, but that’s not how the law works. The key legal question is whether the turn was made safely and lawfully, or whether the truck was approaching at an unsafe speed or in conditions that made it difficult for the driver to react in time. Both scenarios are possible, and I’ve seen examples of each in cases I’ve handled.

Another factor that deserves scrutiny is lighting. A well-lit intersection at 2:30 a.m. looks very different from one with poor signage or non-functioning traffic controls. If visibility was low and the truck’s speed was high, it’s conceivable that even a careful turn could turn deadly.

Ultimately, there’s no way to know what happened here without reviewing things like dashcam footage, ECM data from the truck and any available surveillance video in the area. Those pieces of evidence are essential to understanding what role, if any, the truck driver or their employer played in this crash. Without that, we’re just speculating. But what I can say with confidence is that it’s worth taking a close look. Too often, investigators rely solely on surface details and miss what really led to the crash.
