Commentary by Attorney Michael Grossman

It obviously raises red flags that OSHA alleges there were violations found in their investigations. However, it’s important people understand that an OSHA investigations and getting a worker’s family the resolution they deserve are two separate things. There may be some overlap in evidence required for both processes, but Texas work fatality law is uniquely complex.

Simply put, there isn’t always an automatic process for getting families benefits or seeing accountability after a fatal work accident. That can require navigating a significant legal maze, and a preliminary OSHA report would likely only scratch the surface of what’s needed to navigate that maze. As such, families who have independent investigators prioritizing their needs generally will see better outcomes than those who rely solely on the authorities to get them answers. Texas work fatality law may present many obstacles, but they can be overcome with the right evidence and strategy.
