Commentary by Attorney Michael Grossman
I’ve handled work fatality cases for over 30 years, and OSHA statements like this are unfortunately common. It would surprise folks how often families wait months for answers only to end up asking the same questions they asked on day one.
As such, it should be no surprise that workers’ loved ones often seek out independent professionals who can help fill in the blanks. At the end of the day, they need someone looking out for their needs and prioritizing getting the full story. OSHA’s priorities might align with that somewhat, but their job is ultimately to look for violations and issue citations. That may not be enough to help a family navigate Texas work fatality laws, which are more complex than in any other state in the country.
If it turns out OSHA was more thorough behind the scenes than these public statements suggest, that would be good to hear. That’s just not something I’d ever encourage someone to take for granted.
