Laredo, TX — April 3, 2025, Jose Roberto Martinez was killed as the result of a work accident which took place along Union Pacific Boulevard.

Officials said in an initial OSHA accident investigation summary that the incident occurred off the corner of Union Pacific Boulevard and McPherson Road.

While facts aren’t clear right now, OSHA alleging violations obviously raises some red flags. However, it’s important to know that even if allegations are true, and OSHA takes action against an employer, that’s rarely the end of the story. Let me explain.

Texas has the most complex work fatality laws of any other state in the country. There isn’t always a guaranteed path for a worker’s family to get benefits after an accident. This can leave families up against uncooperative or outright combative employers, and an OSHA investigation alone is rarely enough to level the playing field.

As such, it’s important that fatal work accidents are taken seriously. Just assuming that authorities have everything covered can leave families empty-handed at a time when they most deserve answers. Maybe more steps were taken behind the scenes here to ensure this worker’s loved ones could navigate the legal maze that is Texas work fatality law. In my experience, though, it’s not prudent to take that for granted.
