Commentary by Attorney Michael Grossman
When a single-vehicle crash claims someone’s life, the explanation often stops at the phrase “lost control.” But that kind of shorthand doesn’t explain anything. A fatal outcome like this demands more than assumptions—it calls for a close look at what the vehicle was doing, how it responded, and whether anything could have prevented it.
Did the authorities thoroughly investigate the crash?
An SUV leaving the road and overturning raises immediate questions about how it happened. Did investigators examine the vehicle’s final position, tire tracks, and any signs of braking or swerving? Was the scene mapped out to determine whether the vehicle’s movement could be recreated and understood? Crashes like this can look simple on the surface, but without a full reconstruction, the real cause—driver action, sudden obstacle, or something else—may never be pinned down.
Has anyone looked into the possibility that a vehicle defect caused the crash?
Overturning after leaving the road might suggest a problem with vehicle stability. If the Ford Fusion experienced a mechanical failure—brakes locking, steering loss, or electronic control system malfunction—it could have caused a sudden, unrecoverable loss of control. These systems don’t always leave obvious evidence behind, and if no one inspects the vehicle with the possibility of a defect in mind, those clues are easily missed. It’s a question worth asking, especially in fatal single-car incidents.
Has all the electronic data relating to the crash been collected?
The Ford likely stored information in its event data recorder—speed, throttle position, braking, steering input, and more. That data can reveal whether the driver attempted to correct, or if the vehicle failed to respond. GPS or phone data might also show whether distraction or route deviation played a role. If no one retrieves and secures this information early, the chance to understand what really happened may be lost.
Crashes like this often get written off as unfortunate missteps, but the truth is usually more complicated. Only a complete investigation—mechanical, digital, and physical—can tell the full story.
- A full crash reconstruction is key to understanding how and why the vehicle left the road.
- Mechanical inspections are necessary to rule out steering or braking system failures.
- Onboard data may reveal whether the driver was reacting—or if the car didn’t respond.
