Commentary by Attorney Michael Grossman
It’s not unusual for an OSHA summary to include so few actual details about what led to the accident. What people need to know, though, is that there isn’t always a better explanation behind the scenes. I’ve handled Texas fatal work accident cases for over 30 years now. Families often seek out help because despite thorough OSHA investigations, they’re still left with unanswered questions. Why is that?
Simply put, OSHA has their own priorities. They look for violations, issue citations, and recommend penalties for those alleged violations. Their efforts rarely extend beyond that. And since authorities are generally only interested in potential criminal charges, they’re likely to move on without a thorough investigation, as well. Meanwhile, the worker’s loved ones are left to navigate Texas work fatality laws, which are more complex than in any other state in the country.
That’s why families often seek out help from independent professionals. They find themselves months after an accident just as in the dark as they were on day one. Oftentimes, those are the families that will tend to have the best outcomes. By having someone dedicated to the needs of the worker’s family, they can navigate a legal maze and ensure there is a clear path to the resolution they deserve. Just waiting around assuming OSHA has everything handled will rarely yield those sorts of outcomes.
