Months after a man loses his life on the job, one would expect OSHA to have some answers. Hopefully they’ve been more open with the victim’s loved ones behind the scenes, but that’s not something I’d ever take for granted.
I’ve been handling Texas work fatality cases for more than 30 years. Simply put, Texas has more complex work fatality laws than any other state in the country. OSHA’s priorities don’t necessarily align with helping a worker’s family navigate that legal maze. And employers certainly aren’t going to put anyone else’s needs above their own.
That’s why families generally have the best outcomes when there are independent professionals looking out for their needs. Ultimately, OSHA might wrap up their investigations and find that there were issues surrounding this accident that need to be addressed. But even if they do, that will only be alongside whatever steps are necessary for getting the victim’s loved ones the resolution they deserve beyond just possibly seeing authorities issue a few fines.
