El Paso, TX — February 6, 2024, Nestor Lopez Rodriguez was killed as the result of a work accident at around 2:00 p.m. along Mimosa Avenue.
According to initial details about the accident, it happened off the intersection of Mimosa Avenue and Barker Road, just off Loop 375.
Investigators said that 37-year-old Nestor Lopez Rodriguez was installing pipes in a trench at the time. It appears the trench caved in, resulting in Nestor Lopez Rodriguez suffering fatal injuries. OSHA listed multiple alleged violation citations.

OSHA alleging serious violations following their investigations into this obviously raises some red flags. But it’s important people understand the goals of OSHA don’t necessarily overlap with the needs of a worker’s family. Texas has a separate system for families who lose a loved one on the job. It so happens our work fatality laws are more complex than in any other state in the country. As such, it’s important families have their own evidence and legal strategy approaching that legal maze rather than relying on OSHA to do all the work. Doing so can leave families empty-handed at a time when they most deserve a fair resolution.
