Commentary by Attorney Michael Grossman

It’s very concerning that OSHA apparently found reasons to recommend citations here, but that doesn’t make things as open-and-shut as folks may think. Texas has the most complex work fatality laws in the whole country. To sum it up, there isn’t always a guarantee that a worker’s loved ones will get automatic benefits following an accident. That means they might need a lot more than a simple OSHA summary and even allegations of violations to get a proper resolution. So if steps were taken to go beyond the surface and make sure all factors surrounding the accident have been addressed, there could still be more to the story.
