Commentary by Attorney Michael Grossman
School bus accidents involving injuries to children and adults demand rigorous investigations. While details are limited at this stage, a few critical questions need to be addressed to determine liability and ensure accountability:
Was the bus properly maintained, particularly its brakes and steering systems? Buses are subject to stringent inspection requirements. Failing to meet these standards could implicate the school district in negligence. Similarly, was the SUV in good operating condition? Mechanical issues like brake failure could shift some liability onto its owner.
Was the school bus driver adequately trained and adhering to safety protocols? Training gaps or improper actions, such as distracted driving, could point to negligence on the part of the driver or their employer. It’s also crucial to examine the SUV driver’s actions. Did they fail to yield, speed or engage in unsafe maneuvers? Police reports and potential eyewitness accounts could shed light here.
Was the crash influenced by environmental factors, such as the layout of Santiago Canyon Road or conditions near the crash site? Sharp turns or poor signage can contribute to accidents, raising questions about potential municipal liability. Data from the bus’s onboard systems, including GPS and potentially a dashcam, could clarify the bus’s speed and actions before the collision.
Beyond driver conduct, what role did district policies play in this crash? Were drivers being pushed to maintain tight schedules or given insufficient breaks? Institutional negligence might be relevant here if systemic issues exist.
While specifics of the injuries are unknown, the fact that children were involved makes this case especially sensitive. Proper child safety measures, such as seat belts on the bus, must be examined. The absence of such measures could indicate a broader issue of policy negligence.
Initial reports don’t mention whether authorities have obtained critical evidence like cell phone records or mechanical inspections. If overlooked, these gaps could hinder a full understanding of what caused the crash.
This crash underscores the importance of thorough, independent investigations into every aspect of the incident, from vehicle maintenance to driver conduct and institutional practices. Only by answering these questions can we ensure that the injured parties receive justice.
