Commentary by Attorney Michael Grossman

When I read about a fatal crash like this, my first thought is that the people affected deserve clear answers about what happened. That may seem simple, but in my experience, crash investigations often leave key details unexplored. To fully understand what led to this accident, three critical questions must be asked.

First, did authorities conduct a thorough investigation? When a pedestrian is struck and killed, investigators often focus on whether the pedestrian was visible and where they were crossing. But it’s just as important to analyze the driver’s actions. Was the driver speeding? Were he paying attention? Did road conditions or lighting contribute to the crash? Without examining these factors, it’s impossible to get a complete picture of what happened.

Second, has anyone considered whether a vehicle defect contributed to the crash? The vehicle involved was a 2009 Chrysler Town & Country, a model that, like all older vehicles, may have experienced wear and tear on crucial safety systems. Were the headlights working properly? Did the brakes respond as expected? If a mechanical failure made it harder for the driver to react, that could change the understanding of the crash. Unfortunately, these questions are rarely asked unless someone makes a point to investigate.

Finally, has all available electronic data been collected? Modern vehicles store information that can reveal critical details about a crash, such as speed, braking and steering input before impact. This data could show whether the driver attempted to stop in time. Additionally, nearby businesses or traffic cameras may have captured video footage that provides more context. And in today’s world, cell phone records should always be reviewed to determine whether the driver was distracted at the time.

At the end of the day, a person lost their life, and the least that can be done is to ensure a full and fair investigation that leaves no stone unturned. The family of the young man who was killed deserves real answers, and the only way to get them is by asking the right questions and making sure every piece of available evidence is secured.
