Commentary by Attorney Michael Grossman
Pedestrian accidents can present significant hurdles since a lot of people are quick to just blame pedestrians without a second thought. But it’s important to consider the full context of the accident.
What was visibility like? Was the driver on their phone? Was the victim in a lane of travel or along the shoulder? Was alcohol a factor? Are there any nearby cameras that captured the incident on video? Is this a stretch of road with an unusually high number of pedestrian accidents?
If authorities aren’t asking these kinds of questions, they risk letting something important slip through the cracks. That’s why it can be important to seek out a second opinion if it seems authorities aren’t being thorough in their own efforts.
