Commentary by Attorney Michael Grossman
When a crash sends multiple people to the hospital and little is known about how it happened, it’s a sign that critical details haven’t yet surfaced—or possibly haven’t been uncovered. This is the point in an investigation when the right questions matter most.
1. Did the authorities thoroughly investigate the crash?
Without a clear account of how the two vehicles collided, there’s no way to know whether the scene was fully reconstructed. Did investigators document vehicle positions, measure impact points, or analyze movement patterns leading up to the crash? Were there witnesses, and if so, were their statements consistent? These early steps determine whether the investigation uncovers the full story or leaves key elements to speculation.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Even if two drivers appear to be the only players involved, that doesn’t mean the vehicles performed as expected. A sudden brake failure, malfunctioning steering system, or a stuck accelerator could have played a role. If no mechanical inspections were conducted, it's premature to assume driver error alone. Especially when injuries are involved, every possibility deserves attention.
3. Has all the electronic data relating to the crash been collected?
Both vehicles likely carry onboard data that could clarify key details—vehicle speed, braking efforts, throttle input, and steering angle at the time of the crash. This information is crucial for determining whether either driver attempted to avoid the collision or lost control for other reasons. Investigators should also review any nearby traffic or security cameras to help build an accurate timeline of events.
When the facts are still out of reach, it's all the more important to make sure they’re being pursued—not assumed.
Takeaways:
- Crashes with unknown causes need detailed scene and movement analysis.
- Vehicle failures can’t be ruled out without proper inspection.
- Onboard data and camera footage are vital for building an accurate account.
