Commentary by Attorney Michael Grossman
Crashes like this may seem simple at first glance, but when people are seriously hurt, it’s important to take a closer look at how and why things went wrong.
1. Did the authorities thoroughly investigate the crash?
Serious car accidents require careful scene review beyond just who had the right-of-way. If authorities don’t dig beyond surface-level details, they can miss important factors.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Sudden loss of control, brake failure, or even malfunctioning safety systems could play a role in a collision like this. Unless both vehicles were inspected, that possibility remains open.
3. Has all the electronic data relating to the crash been collected?
Speed, braking, and steering inputs—along with GPS or phone activity—can help fill in the blanks. If that data hasn’t been reviewed, key evidence may still be sitting untouched.
At the end of the day, the evidence needs to be able to speak for itself. That means the priority should be getting as much of it as possible.
Key Takeaways:
- Intersection crashes need clear documentation to establish what happened.
- Vehicle issues could have caused or worsened the collision.
- Data from the vehicles could confirm key details—if it’s pulled and reviewed.
