Commentary by Attorney Michael Grossman
When I read about single-vehicle crashes like this one, my first thought is that I hope investigators are taking a thorough approach to understanding what led to the wreck. Too often, people assume that when a vehicle leaves the roadway, the cause must be driver error. While that’s a possibility, experience has shown me that many other factors can contribute to a crash like this. To get a complete picture of what happened, three critical questions need to be addressed.
The first question is whether authorities are conducting a thorough investigation. While law enforcement is responsible for gathering initial evidence, their level of crash reconstruction training and available resources can vary. In cases like this, where a vehicle unexpectedly leaves the road, it’s important to determine whether investigators are considering all possible explanations. Were there road hazards, poor visibility, or environmental conditions that contributed? Did the driver take evasive action to avoid an animal or another vehicle? A full reconstruction of the crash is necessary to ensure that no detail is overlooked.
The next question—one that is too often ignored—is whether a vehicle defect played a role. Modern vehicles rely on advanced safety and control systems, such as power steering, electronic stability control, and braking assist. If any of these systems failed unexpectedly, the driver may have been unable to maintain control. Additionally, given that one occupant suffered fatal injuries, it’s important to examine whether the vehicle’s safety features, such as airbags and seatbelts, functioned as designed. Unfortunately, potential defects often go undiagnosed because the vehicle is repaired or disposed of before a proper forensic examination takes place. Preserving the vehicle for inspection is critical.
The final question is whether all relevant electronic data has been collected. Most modern vehicles are equipped with electronic control modules (ECMs) that record key details such as speed, braking, and steering inputs leading up to the crash. This data can provide valuable insight into whether the driver attempted to correct the vehicle’s path or if there was a mechanical failure. Additionally, any available surveillance footage, dashcams, or nearby traffic cameras could provide further context. Preserving this evidence quickly is essential before it is lost or overwritten.
At the end of the day, answering these questions isn’t just about understanding this crash—it’s about ensuring that those affected have the full picture. Serious crashes leave families searching for answers, and the least we can do as a community is ensure that every possible factor is investigated so that no question is left unanswered.
