Commentary by Attorney Michael Grossman

When I see a report like this, my first thought is that I hope the injured pedestrian gets the answers he needs about what caused this crash. Pedestrian accidents can be especially complex, and while the report confirms that a vehicle struck a pedestrian, it does not explain why. To truly understand what happened, three critical questions must be asked.

First, did the authorities thoroughly investigate the crash? Determining how and why a pedestrian was struck requires more than just documenting the scene. Investigators should consider factors such as lighting, visibility, traffic signals and whether the pedestrian was in a marked crosswalk or an unprotected area of the roadway. Were there any obstructions that may have prevented the driver from seeing the pedestrian? Did authorities check for surveillance footage from nearby businesses or traffic cameras to capture what happened in the moments before the crash? A complete investigation is necessary to provide a full picture of the events leading up to the collision.

Second, has anyone looked into the possibility that a vehicle defect contributed to the crash? While pedestrian accidents are often assumed to be caused by driver or pedestrian actions, mechanical failures — such as brake malfunctions, steering issues or sensor failures in modern driver-assistance systems — should not be ruled out. The 2019 Nissan Sentra may be equipped with automatic emergency braking or pedestrian detection systems that should have engaged in time to avoid a collision. If these systems failed, that would significantly change the understanding of the crash. Unfortunately, vehicle defects are rarely examined unless someone specifically pushes for a forensic inspection. If the car is repaired or discarded before an expert can examine it, crucial evidence could be lost.

Third, has all the electronic data relating to the crash been collected? The Nissan Sentra’s engine control module (ECM) may contain key data such as speed, braking activity and steering inputs in the moments before impact. Additionally, nearby surveillance cameras, dashcams or even cell phone data could provide valuable insights into the circumstances surrounding the crash. Without this data, authorities may only have part of the story, which could leave important questions unanswered.

At the end of the day, pedestrian crashes leave those involved searching for answers. The least we can do is ensure that every possible step is taken to uncover the full truth.
