Commentary by Attorney Michael Grossman
Authorities haven’t put out much information about this crash, so there are plenty of questions for investigators to answer. My experience has taught me that three questions should be addressed during the course of the investigation.
1. Did the authorities thoroughly investigate the crash?
In this case, authorities should:
- Assess road design and conditions: Investigators should examine whether the location had adequate barriers, signage or lighting to deter or warn pedestrians from crossing.
- Analyze the driver’s behavior: It’s important to evaluate whether the driver was speeding, impaired or distracted before striking the pedestrian.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
While the driver’s actions are central to the investigation, vehicle functionality must also be considered:
- Lighting and visibility: Did the vehicle’s headlights adequately illuminate the roadway, especially in the early-morning hours? Poor lighting could reduce the driver’s ability to see a pedestrian in time.
- Brake performance: A detailed inspection of the vehicle’s braking system is necessary to determine whether the driver was able to apply adequate stopping force.
- Advanced driver-assistance systems (ADAS): If the vehicle was equipped with pedestrian detection or emergency braking systems, investigators should verify whether they were active and functioning correctly.
3. Has all the electronic data relating to the crash been collected?
Critical data from the involved vehicle and surrounding traffic systems can help clarify the events leading up to the collision. Key data to gather includes:
- Engine Control Module: This can reveal speed, braking input, and steering activity just before the collision.
- Traffic and surveillance cameras: If available, footage from nearby cameras could show the pedestrian’s actions and the vehicle’s approach.
- Infotainment and telematics data: These logs could indicate if the driver was distracted by in-car systems, such as navigation or phone use.
- Cell phones: Information from the phones of the pedestrian, driver or others near the crash site could help piece together what happened.
A thorough investigation should answer all of these questions to provide deserved piece of mind to the victim’s family. If the investigation can’t answer these questions, perhaps the family should arrange for another look at the accident so they feel like they truly know what happened.
