It’s worth asking, how does something like this happen? A driver is accused of being intoxicated behind the wheel, leading to a serious crash, yet most investigations stop at the driver. What’s often overlooked is how that driver ended up impaired in the first place.
When a driver is arrested for DWI following a crash, it’s important to investigate where they obtained alcohol and whether they were overserved. Under Texas dram shop law, alcohol providers who serve an obviously intoxicated person can be held accountable if that individual goes on to cause harm. Yet, more often than not, these details are left out of the official reports.
In many cases, drunk drivers aren’t just having a casual drink before getting behind the wheel. Instead, they’ve been drinking at a bar or restaurant where staff failed to cut them off when it was clear they had too much. If that happened here, then the establishment that served the driver may bear responsibility alongside the individual who made the choice to drive.
While authorities continue their investigation into this crash, it’s critical that all avenues are explored: not just the driver’s actions, but also whether a business played a role in enabling them. Identifying the source of alcohol is a crucial step toward accountability and ensuring that establishments follow the law, helping to prevent similar crashes in the future.
