Commentary by Attorney Michael Grossman
When a vehicle leaves the road and rolls, especially when someone is ejected, it signals a situation that needs more than routine answers. Understanding what caused the loss of control—and whether it could have been prevented—requires asking questions that don’t always get asked in the rush to move forward.
Did the authorities thoroughly investigate the crash?
A single-vehicle rollover is often treated as straightforward, but that can lead to missed opportunities to uncover deeper causes. Investigators should carefully document vehicle positioning, road contact marks, and any mechanical clues that could suggest how control was lost. That means using mapping tools, reconstructing the vehicle’s path, and reviewing the driver’s conduct leading up to the crash. It’s worth noting that not every crash unit has the same level of training or resources, which can affect how thoroughly an incident is analyzed.
Has anyone looked into the possibility that a vehicle defect caused the crash?
A car suddenly veering off the road could be linked to anything from steering failure to brake lockups to suspension issues. Even systems designed to help—like traction control—can behave unpredictably if something’s wrong under the hood. Without a detailed mechanical inspection of the Dodge Avenger, especially after a rollover and ejection, it’s impossible to know whether a defect contributed to the crash.
Has all the electronic data relating to the crash been collected?
Today’s vehicles capture a significant amount of crash-related data, including speed, throttle position, braking inputs, and whether safety systems like airbags and seatbelts were functioning. That information is essential in rollovers, where timing and vehicle behavior are key to understanding what went wrong. Without reviewing that data, any conclusions about how and why the crash happened are incomplete at best.
Every rollover has layers, and those layers deserve to be peeled back. It’s not just about how the vehicle ended up off the road—it’s about why it couldn’t stay on it in the first place.
Key Takeaways:
- Rollover crashes require detailed reconstruction to identify contributing factors.
- Mechanical failures should be considered and ruled out through a full inspection.
- Electronic vehicle data can offer crucial insight into how control was lost.
