Commentary by Attorney Michael Grossman
Single-vehicle accidents like this one may seem simple, but they often involve underlying factors that require careful investigation. To understand what happened, it’s important to ask some critical questions.
First, did authorities have the time and tools to thoroughly investigate the crash? A vehicle veering off the road could result from road hazards, poor visibility, or environmental factors. Did investigators document the scene carefully, examining tire marks, debris, or road conditions? Without a detailed analysis, key evidence could be missed.
Second, could a vehicle defect have contributed to the crash? Mechanical failures, like brake or steering malfunctions, or safety system issues, such as faulty seatbelts or airbags, can play a significant role. A prompt forensic inspection of the vehicle is necessary to uncover any defects that might explain the loss of control.
Finally, was all electronic evidence collected? Vehicles store vital data in their Engine Control Modules (ECMs), capturing details like speed, braking, and steering inputs. Other sources, such as cellphone records or nearby video footage, might also provide context. Securing this evidence quickly is critical to preserving it.
By asking these questions, authorities have an opportunity to reassure victims that the investigations are in good hands. However, if their answers don't add up or fail to alleviate serious doubts, it gives victims and families a chance to seek out alternative avenues to get the answers they need.
