Commentary by Attorney Michael Grossman
When a vehicle veers off the road, strikes a tree, and catches fire—with no other vehicles involved—it’s a situation that raises more questions than answers. These are the kinds of crashes where surface explanations fall short, and where a thorough investigation is absolutely necessary to understand what truly happened.
1. Did the authorities thoroughly investigate the crash?
With a crash involving fatal injuries, fire, and no clear cause, it’s essential that investigators went beyond basic scene review. That means reconstructing the vehicle’s path, identifying signs of overcorrection or sudden steering, and determining whether there were any last-second braking attempts. This kind of analysis can help uncover whether the driver lost control due to distraction, a sudden emergency, or something else entirely. Whether those steps were taken often depends on the experience and equipment available to the investigating team.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Losing control without another vehicle involved raises serious concerns about the vehicle’s mechanical condition. A tire failure, steering malfunction, or problem with the vehicle’s stability system could all have played a role. The fact that the vehicle caught fire after impact adds another layer—pointing to potential fuel system vulnerabilities or electrical faults. Unless the Kia Forte was thoroughly inspected post-crash, these contributing factors may remain unknown.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles often record pre-crash data such as speed, braking input, and steering actions. That information can clarify whether the driver attempted to avoid the crash or if the vehicle didn’t respond as expected. GPS and mobile phone data may also provide insight into what was happening in the moments before impact. If this data wasn’t collected early, those answers may already be lost.
Crashes like this often leave little behind but damage—and questions. Finding out what happened depends on a real commitment to looking beyond assumptions and into the details.
Takeaways:
- Solo crashes ending in fire require full reconstruction and analysis of vehicle behavior.
- A mechanical or fuel system failure may have contributed and must be carefully inspected.
- Electronic vehicle data can provide critical insight into what triggered the loss of control.
