Commentary by Attorney Michael Grossman
While nothing has been confirmed right now, alcohol is a common factor after any early morning wreck, let alone one on one of the biggest drinking holidays of the year. What makes that important to consider, though, isn’t just in regards to a potential drunk driver. It’s also important to find out where the alcohol came from, as there may be a local bar responsible for contributing to the accident.
Simply put, alcohol providers in Texas can face consequences when they over-serve someone who is obviously intoxicated. This can include potential criminal investigations, fines, suspended licenses, or liability if the intoxicated driver gets themselves or others hurt. Not only do these avenues present a way to hold a negligent alcohol provider accountable, it helps put them on a path to clean up their act so others aren’t hurt in the future.
Unfortunately, this isn’t always an area of the law that gets the attention it deserves. I talk to people all the time involved in drunk driving accidents where authorities never bothered investigating a complicit alcohol provider. So if there is one involved here, it may take more thorough independent investigations to get a proper conclusion.
