Commentary by Attorney Michael Grossman
When it comes to serious accidents like this, people have a tendency to put all of the focus on the drivers involved. That’s understandable, but investigations should also be able to consider the needs to passengers involved. It’s highly unlikely they did anything to contribute to their own injuries, so there needs to be clear evidence about what happened and how it could have been avoided. This could be for accidents caused by tire blowouts, vehicle defects, drunk drivers, road design issues, or any number of other things a passenger wouldn’t have control over. So while exact factors about the accident aren’t clear right now, there’s likely every reason for there to be thorough investigations.
