Commentary by Attorney Michael Grossman
If the allegations here are true, an alleged drunk driver facing charges may seem pretty open-and-shut. However, there could be more to the story. I’ve handled hundreds of cases involving drunk drivers, and there’s usually an accomplice to investigate: a negligent alcohol provider.
Simply put, bars and other establishments in Texas have rules to follow when serving alcohol. One of those rules is they’re not supposed to serve people who are obviously intoxicated. If they do so, and that intoxication leads to injuries or death, the alcohol provider can be responsible for their role in that harm.
Too often, authorities overlook this area of Texas law. They have a lot on their plates, so when there’s a driver facing charges, they tend to just move on. Meanwhile, there could be a bar or other local business putting the community at risk. So if victims and families want to see full accountability after a crash like this, they should make sure someone is asking where the alleged drunk driver got their alcohol from.
