Commentary by Attorney Michael Grossman
When people hear about a single-vehicle crash, the common assumption is that the driver must have simply made a mistake. But having spent years looking into crashes, I know that many of these incidents are far more complex than they first appear. Before reaching any conclusions, it’s important to ensure that the investigation answers three key questions.
First, did the authorities thoroughly investigate the crash? Law enforcement officers typically document the scene, but the depth of their investigation depends on available resources, training, and competing priorities. In a rollover crash like this one, accident reconstruction can be especially important in determining what led to the loss of control. Factors such as road conditions, possible mechanical failures, or external influences like another driver’s actions should all be considered. However, without a detailed forensic review, these possibilities may go unexplored.
Second, has anyone looked into the possibility that a vehicle defect contributed to the crash? Rollovers can sometimes be linked to stability issues, suspension failures, or even tire defects. Electronic stability control (ESC) systems are specifically designed to prevent rollovers, but if they fail, drivers may be left with little ability to regain control. The challenge is that vehicle defects are rarely investigated unless someone preserves the vehicle and conducts a detailed examination. Unfortunately, in many cases, vehicles are quickly disposed of before anyone has the chance to determine whether a defect played a role.
Finally, has all the electronic data related to the crash been collected? The vehicle’s electronic control module (ECM) likely contains key data such as speed, steering input, and braking activity in the moments leading up to the crash. Additionally, cell phone records could help determine whether distraction was a factor, and surveillance footage from nearby businesses or traffic cameras may provide further insight. This type of evidence doesn’t last forever—ECM data can be overwritten, surveillance footage is often deleted within days, and vehicles themselves may be lost to salvage—so ensuring that this information is preserved quickly is critical.
At the end of the day, the most important thing is that the person injured in this crash and their loved ones get real answers about what happened. Serious crashes can have life-altering consequences, and the least we can do as a community is ensure that every possible factor is considered so that those affected aren’t left with unanswered questions.
