Injuries Reported in Car Accident on State Hwy 95 in Bastrop County, TX
Bastrop County, TX — January 21, 2023, a 19-year-old woman was seriously injured in a crash with a suspecting DWI driver on State Highway 95 in Bastrop County.
Authorities say the incident happened around 2:50 p.m. on Highway 95 near Old McDade Road. Preliminary investigation suggests a Kia Forte was headed north on the highway as a Toyota Camry was southbound on the other side. The Kia driver reportedly slowed and signaled a turn, but hesitated as the Toyota approached. The Kia then quickly turned and the Camry crashed into its passenger side.
A passenger in the Toyota was seriously injured in the collision. The Kia's occupants both received minor injuries and the Toyota driver was possibly hurt.
Investigators alleged that alcohol consumption might have been a factor but that is currently unverified.
No further information is currently available.

Commentary by Attorney Michael Grossman
A mistake I've seen many people make is assuming that officers' preliminary theories in reports are actually ironclad facts. In many ways they're just best guesses from the limited information at the scene, and in general they should just be a basis for further investigation. Rarely do they contain every single important or relevant detail about the accident.
This actually comes up a lot in relation to supposed DWI accidents. The very mention of the word "alcohol" is enough for some to wind up and throw the book at the person who allegedly drank and drove, but it's always best to withhold judgment and see impairment as the theory it currently is. If it's verified by clear evidence there may be further questions to answer, but it can't be taken for granted and other possible explanations must be considered too. Some factors might have been within the driver's control, but others—vehicle malfunctions, slippery roads, a medical emergency—certainly wouldn't.
That's why it's always best to investigate carefully and thoroughly, evaluate all the possibilities, and ultimately let only facts and evidence tell the story. In the end everybody affected by the wreck deserves to know the whole story.
