Commentary by Attorney Michael Grossman
When I see reports of a crash linked to road rage, I know many people assume it’s simply a case of one driver acting recklessly. But experience has taught me that even when emotions run high, the physical evidence of a crash still needs to be carefully examined. Before anyone assumes they fully understand what happened, there are three critical questions that should always be asked to ensure a complete and accurate investigation.
The first question is whether authorities conducted a thorough investigation. While witness statements and driver intent are important, the physical evidence should also be carefully documented. Were there skid marks or sudden maneuvers that suggest one vehicle was trying to avoid the other? Did officers examine damage patterns to confirm how the vehicles made contact? Even in cases where road rage is a factor, it’s important to ensure that the investigation is based on clear, objective evidence rather than assumptions about driver behavior.
The second question is whether a vehicle defect contributed to the crash. The Lexus RX350 involved in this collision is nearly 20 years old, meaning it may have underlying mechanical issues that worsened the situation. If the steering or braking systems malfunctioned at a critical moment, the driver may not have been able to regain control, even if road rage played a role in how the crash started. While driver behavior may be the primary focus of the report, it’s worth considering whether a mechanical failure made things worse. A forensic examination of the Lexus could help determine if a defect played a role.
The third question is whether all electronic data has been collected. Both vehicles likely have engine control modules that can provide key details about speed, braking and steering inputs in the moments leading up to the crash. Additionally, nearby surveillance footage or doorbell cameras in the neighborhood may have captured video evidence of how the situation escalated. Given that the report mentions cell phone use, it’s also important to determine whether distraction played a role. Was the driver of the Lexus still handling his phone at the time of impact? Without securing this data quickly, key evidence could be lost.
At the end of the day, crashes like this highlight how quickly a situation on the road can escalate. But even when emotions are involved, a complete investigation is the only way to ensure an accurate explanation of what happened. When someone is seriously injured, the least the community owes them is the full story.
