Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured driver receives the care he needs and that those affected find the answers they deserve. While it may appear to be a simple case of a vehicle running through an intersection and striking a structure, my experience has shown that unusual single-vehicle crashes like this often raise more questions than they answer. Before reaching any conclusions, there are three critical questions that must be asked to ensure the investigation is as thorough and informative as it needs to be.
The first question is whether authorities conducted a comprehensive investigation. A vehicle traveling through an intersection without stopping and crashing into a structure raises immediate questions about whether the driver was attempting to avoid something, suffered a medical emergency, or was responding to a roadway hazard. Investigators need to look beyond just the point of impact and assess the condition of the roadway, visibility, signage, and any surveillance footage that might provide a clearer picture of the moments leading up to the crash.
The second question—often overlooked—is whether a mechanical defect played a role in the crash. If the truck’s braking system failed or there was an issue with the throttle or steering system, that could explain why the vehicle didn’t stop and ultimately veered off course. Vehicles are complex machines, and even something like a stuck accelerator or faulty sensor could produce a chain reaction leading to a crash. To uncover these kinds of failures, it’s essential that the vehicle is preserved for a forensic examination. Without that, critical evidence may be lost before it can be analyzed.
The third question is whether all available electronic data has been collected. Modern vehicles are equipped with electronic control modules (ECMs) that record critical information such as speed, throttle position, brake usage, and steering input just before a crash. That data can help explain whether the driver attempted to stop, how the vehicle responded, and how quickly the situation developed. Additionally, nearby surveillance footage, traffic cameras, or data from the driver’s cell phone might offer important context. This evidence is often time-sensitive and needs to be secured before it’s overwritten or lost.
At the end of the day, answering these three questions isn’t just about assigning responsibility—it’s about ensuring the injured driver and the community have access to the full truth. Crashes like this are alarming not just because of the outcome, but because of the uncertainty they leave behind. As a community, the least we can do is ensure that every possible explanation is considered and that no stone is left unturned in the pursuit of clarity.
