Commentary by Attorney Michael Grossman
Whenever a vehicle crosses into another’s path or causes a violent rollover, surface-level answers aren’t enough. The real question is whether the investigation digs deep enough to explain why things went so wrong—and whether those findings are backed by facts, not guesswork.
Did the authorities thoroughly investigate the crash?
When one vehicle strikes another with such force that it rolls off the road, investigators need to treat it like a complex puzzle. That means charting the path of both vehicles, checking for signs of evasive action, and analyzing impact angles. Did officers examine whether either driver was reacting to something else? Were speed estimates made using physical evidence, not just witness statements? These kinds of questions can’t be answered without a thorough crash reconstruction, which not every agency has the training or tools to perform.
Has anyone looked into the possibility that a vehicle defect caused the crash?
It’s easy to focus on driver behavior, but mechanical issues can’t be ignored—especially when a vehicle suddenly swerves or makes unexpected contact. Could the Jetta have suffered a steering failure, brake issue, or electronic malfunction that left the driver unable to correct in time? With the truck ending up in a rollover, there’s also reason to inspect whether its stability systems worked as intended. Unless both vehicles are carefully inspected, any underlying defects could remain buried.
Has all the electronic data relating to the crash been collected?
Vehicles involved in high-impact crashes like this often store key information—speed, brake usage, steering input, and even whether lane assistance systems were active. Paired with GPS and phone data, investigators can reconstruct what happened second-by-second. The bigger issue is whether anyone retrieved that data before it was lost. If not, an opportunity to uncover vital facts may have slipped away.
Getting to the truth after a crash like this isn’t just about identifying fault. It’s about making sure no detail—mechanical, behavioral, or digital—gets overlooked.
Takeaways:
- A full crash reconstruction helps reveal how and why the collision occurred.
- Mechanical issues in either vehicle could have played a role and must be checked.
- Digital data from the cars may provide critical insight if reviewed promptly.
